Terms of Use

1. Acceptance of Terms

By creating an er@ account or using the er@ app, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use er@.

These Terms constitute a legally binding agreement between you and Arty Fishall LLC ("er@," "we," "us," or "our").

2. Eligibility

• You must be at least 13 years old to use er@.
• If you are between 13 and 17, a parent or legal guardian must review and agree to these Terms on your behalf. We collect this confirmation during account creation.
• You must provide accurate information when creating your account, including your real age.
• You may only have one er@ account. Creating multiple accounts to evade a ban is prohibited.
• You must be a human. Accounts operated by bots or automated tools are not permitted.

3. Your Account

You are responsible for maintaining the security of your account and password. Do not share your login credentials with anyone. You are responsible for all activity that occurs under your account.

Your er@ handle (e.g., er@tony) is your public identity on the platform. Handles may not impersonate real people, brands, or other er@ users.

4. Content You Post

You retain ownership of the content you post on er@. By posting content, you grant Arty Fishall LLC a limited, non-exclusive, royalty-free license to store, display, and distribute your content solely for the purpose of operating the er@ service.

This license ends when your content expires or when you delete your account. We do not use your content to train AI or machine learning models.

5. Prohibited Content

You may not post content that:

• Is sexually explicit or pornographic
• Depicts, promotes, or facilitates harm to minors in any way
• Constitutes harassment, bullying, threats, or targeted abuse of any individual
• Promotes or facilitates self-harm, suicide, or eating disorders
• Contains hate speech targeting any person or group based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Constitutes spam, phishing, or deceptive content
• Impersonates any person, brand, or entity
• Contains malware, viruses, or malicious code
• Violates the intellectual property rights of any third party
• Violates any applicable law or regulation

6. Prohibited Behavior

• Creating fake accounts or impersonating others
• Using automated tools, bots, or scripts to interact with er@
• Attempting to circumvent any privacy, security, or content moderation feature
• Scraping, harvesting, or collecting data from er@ without written permission
• Coordinating harassment campaigns against any user
• Buying, selling, or transferring er@ accounts

7. Enforcement

We reserve the right to remove any content that violates these Terms, with or without notice. For serious violations — including CSAM, credible threats of violence, or coordinated harassment — accounts will be permanently terminated immediately.

For other violations, we may issue warnings, temporarily restrict features, or permanently ban accounts at our discretion. We are not obligated to provide a reason for content removal or account action.

If you believe content on er@ violates these Terms, you can report it within the app. We review all reports.

8. er@+ Subscription

• er@+ is a paid subscription that unlocks additional features (4th pin slot, 7-day photo expiry, era themes, crown badge).
• Subscriptions are managed through Apple App Store or Google Play and are subject to their terms.
• er@+ auto-renews unless cancelled at least 24 hours before the renewal date.
• A 7-day free trial is available on your first er@+ subscription. Only one free trial per Apple ID or Google account.
• If your er@+ subscription lapses, your 4th pin slot will be locked (but not deleted). Your existing photos will retain their expiry window. You will not lose era archive data.
• We do not offer refunds for unused subscription periods, except where required by applicable law.

9. Privacy

Our Privacy Policy describes how we collect, use, and protect your information. By using er@, you agree to our Privacy Policy.

10. Intellectual Property

The er@ name, logo, wordmark, and all related branding are the property of Arty Fishall LLC. You may not use our trademarks without written permission.

The er@ app and its underlying technology are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the er@ app.

11. Disclaimers

er@ is provided "as is" without warranties of any kind. We do not guarantee that er@ will be available at all times, error-free, or free from security vulnerabilities. We are not responsible for content posted by users.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Arty Fishall LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use er@.

13. Governing Law

These Terms are governed by the laws of the United States and the state of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Duval County, Florida.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification at least 30 days before they take effect. Your continued use of er@ after the effective date constitutes your acceptance of the updated Terms.
